 Imran Hayat – Senior Counsel, Michelman & Robinson Imran Hayat is a skilled and highly versatile litigation attorney, handling sophisticated issues in hospitality, real estate, banking and intellectual property.

Mr. Hayat’s clients include hotels, Fortune 500 banking and financial institutions, as well as real estate and technology companies. He counsels financial institutions and litigates complex class and individual actions involving commercial mortgage-backed securities, the Dodd-Frank Act, the Truth in Lending Act, the Real Estate Settlement Procedures Act, the Fair Credit Reporting Act, the Equal Credit Opportunity Act, the Fair Housing Act and the Fair Debt Collection Practices Act, among others. Mr. Hayat has significant experience in the hospitality industry, representing hotels in a myriad of real estate matters.

He counsels real estate holding companies, shopping mall owners and developers from pre-trial through appeal in a wide range of litigation matters, including breach of contract, bankruptcy, unlawful detainer and mechanics’ lien actions. He has tried several high profile cases on behalf of prominent companies such as Blackrock Realty and Westfield, LLC, as well as large governmental organizations including the Los Angeles Unified School District. One of Mr. Hayat’s notable published decisions, Hotels Nevada v. L.A. Pacific Center, Inc., (2006) 114 Cal. App. 4th 754, established the procedure a court must undertake before ruling on pre-arbitration disputes.

Several of his significant litigation victories have transformed California law. He successfully argued before the Ninth Circuit, affirming his client’s ability to maintain a lien in first priority despite mistakenly paying off the mortgage on a property due to third-party fraud. Mr. Hayat also obtained a groundbreaking decision on the remand of Mabry v. Superior Court, (2010) 185 Cal. App. 4th 208, in which the court held that only substantial, and not strict, compliance with California Code of Civil Procedure, § 2923.5 was required, affecting the steps that must be taken prior to the recording of a default notice.
